Arbitration

A voluntary but binding arbitration is available where an applicant is pursuing an unfair dismissal claim. The applicant must receive independent advice and the parties must agree in writing to be bound by the decision before proceedings. The hearing is private, there is a bar on any further tribunal hearing on the claim and the arbitrator can award reinstatement or compensation. The decision of the arbitrator is final. There is no appeal to the Employment Appeal Tribunal (EAT).
